These Terms & Conditions ("Terms") govern your access to and use of this website, and your purchase of any products or services offered through it. They apply to all users of the site, including browsers, customers, vendors, and contributors of content, across memobottle.com

References throughout these Terms to "memobottle," "we," "us," or "our" refer to memobottle Pty Ltd. By accessing this website, placing an order, or otherwise engaging with our Service, you agree to be bound by these Terms in full, together with our Returns, Refunds & Warranty Policy and Privacy Policy, each of which forms part of this agreement.

We reserve the right to amend these Terms at any time, at our sole discretion, and any such amendment will take effect immediately upon being published to this page. We'd encourage you to review this page periodically, as your continued use of the website following any update constitutes your acceptance of the revised Terms. We also reserve the right to refuse service, cancel or limit orders, restrict access to the site, or discontinue any part of the Service, at any time and without prior notice, where we reasonably believe it necessary to do so.

If you do not agree to these Terms, or to any amendment made to them, we ask that you discontinue use of the website and refrain from purchasing our products.

Returns, Refunds & Warranty Policy


Memobottle Two-Year Manufacturing Warranty

Memobottle Pty Ltd will, at its discretion, repair or replace any product found to have a manufacturing defect within two (2) years of the original purchase date, free of charge. This warranty does not extend to damage resulting from normal wear and tear, accidental damage, loss or theft, improper care or cleaning, non-standard use, or negligence. Eligible products must have been purchased directly from memobottle.com or from an authorised memobottle dealer.

Making a Warranty Claim

If you believe your item has a manufacturing fault, simply email us at hello@memobottle.com within 24 months of your original purchase date, along with your order number or valid proof of purchase so we can locate your details quickly. From there, our team may ask you for a little more information or photo evidence to help us understand the issue, and once your claim has been reviewed, we'll be in touch with a return address so the item can be sent back to us.

Once your returned item has been received and inspected, we'll notify you by email of the outcome. Approved refunds are credited to the original payment method within 20–25 business days, and approved replacements are dispatched within 10–15 business days at memobottle's expense — though delivery timeframes may vary depending on your location.

Exclusions — What Is Not Covered

While we stand firmly behind the quality of our products, there are certain circumstances in which memobottle is unable to offer a refund, replacement, or exchange. These exclusions exist to ensure our warranty remains focused on genuine manufacturing faults, rather than matters of personal preference or issues outside our control.

Change of Mind & Ordering Errors

A change of mind after purchase does not qualify for a refund or exchange. This also extends to orders affected by an incorrect shipping address entered at checkout, as we're unable to redirect or reroute a parcel once it has been dispatched to the address provided, as well as orders where the wrong item, colour, or size was selected. These are the customer's responsibility, and unfortunately can't be corrected after the fact, so we'd always encourage a careful check of your selection and delivery details before completing a purchase.

Product Perception & Characteristics

We're not able to offer a refund where a customer finds that the product material differs from what they expected, or where they're dissatisfied with the colour or transparency of the item received, as these are matters of personal preference rather than faults in the product itself. It's also worth noting that a new bottle may carry a faint smell when first received; this is a normal characteristic of the materials used and will dissipate naturally after the first few cleans and uses — it is not considered a defect.

Damage & Sale Items

Any damage caused by the user through misuse, negligence, or normal wear and tear falls outside our warranty. Items purchased as part of a sale or clearance offer are also sold on a final-sale basis and are excluded from refund or exchange.

Delivery & Freight

Once an order leaves our warehouse, its journey is placed in the hands of our freight partners. As such, we're not able to offer refunds or compensation for delivery delays caused by the freight carrier, customs processing, incorrect address details provided by the customer, or any other circumstance beyond memobottle's reasonable control. We understand delays can be frustrating, and we're always happy to help track down a parcel or liaise with our courier partners where needed — but responsibility for transit time ultimately sits with the delivery provider once goods are dispatched.

Refund Conditions & Timeframes

To help us process your request as smoothly as possible, there are a few conditions that apply to all refund claims. Refund requests must be submitted within 30 days of receiving your item, so we'd encourage reaching out to us as soon as you notice an issue. We understand that circumstances aren't always straightforward, so requests made outside this window will still be considered on a case-by-case basis.

We'll also need valid proof of purchase, such as your order number or receipt, to verify the claim and locate your order details. Once submitted, each request is reviewed individually by our team, and memobottle reserves the right to decline a refund where our inspection doesn't support the claim being made — this helps ensure our warranty remains fair and consistent for all customers.

If a refund has been approved but not received, please first check with your bank, then your card provider, as processing times can vary. If the issue persists, contact hello@memobottle.com

Return Shipping

If your item needs to be sent back to memobottle HQ for inspection, please note that the cost of return shipping is the customer's responsibility and is non-refundable. For items valued over $75, we'd recommend using a trackable shipping service or purchasing shipping insurance, as memobottle Pty Ltd isn't able to take responsibility for parcels lost in transit back to us.

Key Definitions

Manufacturing Defect — the product departs from its intended design or function. Defective materials or workmanship are covered for 24 months from purchase.

Wear and Tear — the natural and expected deterioration of a product resulting from normal use over time; this is not covered under warranty.

Intended Design and Function — memobottle products are designed for the carrying and consumption of water. They are not designed to withstand significant force or impact, or prolonged exposure to high temperatures, direct sunlight, or heat (e.g. left in a vehicle). Products should not be stored adjacent to high-value items such as laptops, tablets, or phones where impact could cause damage to those items.

This website is operated by memobottle Pty Ltd ("we", "us", "our"). By accessing or using this website, or by purchasing any product through it, you agree to be bound by these Terms & Conditions in full.

We reserve the right to amend these Terms & Conditions at any time, and any amendment will take effect immediately upon being published to this page. Your continued use of the website following an update simply reflects your acceptance of the revised Terms, so we'd recommend giving this page a quick look each time you visit. If at any point you don't agree with these Terms, or an amendment made to them, we'd ask that you discontinue use of the website and refrain from purchasing our products.

By using this site, you're confirming that you're of legal age in your jurisdiction, or that you hold parental or guardian consent to do so. We ask that you don't use the site for any unlawful purpose, to transmit malicious code, or in a way that breaches applicable law — and where these Terms are breached, we reserve the right to immediately terminate your access to the Service.


General Conditions

We reserve the right to refuse service to any person, at any time, and for any reason we see fit. Beyond that, we ask that no part of the Service — its content, design, or functionality — be reproduced, resold, or otherwise exploited without our prior written consent. Please also keep in mind that content on this site is provided for general informational purposes only, and shouldn't be solely relied upon when making decisions.

Pricing & Product Availability

Prices displayed in USD, EUR, or AUD (depending on region) are subject to change without notice, and we reserve the right to modify, limit, or discontinue any product or service at any time. We also reserve the right to restrict order quantities or decline orders where we reasonably believe they originate from unauthorised resellers or distributors.

Order Cancellation Due to Error

We're only human, and on the rare occasion a product may be listed with an incorrect price, description, or image due to a genuine error or oversight on our part. Where this happens, memobottle reserves the right to cancel the affected transaction, and the full amount debited will be refunded to your nominated payment method as soon as reasonably practicable. Cancellation may also apply to the misuse of markdown codes and discount offers without requiring an explanation.

Once your order has been dispatched, we'll provide a tracking link via our third-party logistics provider so you can follow its journey. From the point of dispatch, risk of loss or damage to the goods passes to the customer.

Accuracy of Account Information

We ask that you provide accurate, current, and complete account and billing information when using our site, and that you keep this updated as needed. We reserve the right to correct any errors, including pricing errors, and to cancel orders where necessary — even after an order has already been submitted.

Third-Party Tools & Links

This site may occasionally provide access to third-party tools or contain links to third-party websites. These are made available on an "as is" and "as available" basis, without warranty of any kind, and memobottle Pty Ltd accepts no liability for your use of, or reliance upon, any third-party tool, content, product, or service.

Customer Submissions

Any feedback, comments, or suggestions you share with memobottle may be used, edited, published, or otherwise utilised by us across any medium, without obligation or compensation to you. In turn, you're responsible for ensuring anything you submit doesn't infringe the rights of any third party, or contain unlawful, offensive, or defamatory material.

Prohibited Uses

We ask that this site not be used to engage in unlawful activity, infringe intellectual property rights, harass or discriminate against any person, distribute malicious code, submit false or misleading information, or interfere with the security or functionality of the Service in any way. Where any of these conditions are breached, memobottle reserves the right to terminate access to the site.

Limitation of Liability

The Service, and all products supplied through it, are provided "as is" and "as available", without warranty of uninterrupted or error-free operation, to the fullest extent permitted by law.

Where liability is established, memobottle Pty Ltd's total liability to you is limited to the total value of the goods purchased in the relevant transaction. We also won't be held liable for any failure to meet our obligations under these Terms where that failure arises from circumstances beyond our reasonable control — including, but not limited to, natural disasters, supplier failures, or similar disruptive events.

Indemnification

You agree to indemnify and hold harmless memobottle Pty Ltd, its officers, directors, employees, and agents from any claim or demand — including reasonable legal fees — arising from your breach of these Terms, or your violation of any law or the rights of a third party.

Intellectual Property

All content on this website — including text, graphics, layouts, and branding — is owned by or licensed to memobottle Pty Ltd. You're welcome to download content for personal, non-commercial use, though no right, title, or interest in that material is transferred to you as a result. Reproduction, distribution, or commercial exploitation of our site content isn't permitted without our prior written consent.

Severability & Governing Law

These Terms are governed by the laws of Australia. Should any provision within them be found unlawful, void, or unenforceable, that provision will simply be severed, without affecting the validity or enforceability of the remaining Terms.
